Terms of Service

These Terms of Service ("Terms") govern your use of Awakefit (the "App"), operated from the European Union ("we," "us," "the Operator"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. Eligibility

You must be at least 16 years old to use Awakefit. We require this age threshold because we rely on your consent as a legal basis for several features (e.g., camera access, notifications, and Screen Time authorization), and EU data protection rules apply. If you are under 16, please do not use the App.

2. License Grant

We grant you a personal, non-exclusive, non-transferable, revocable license to download and use Awakefit on Apple devices you own or control, solely for your personal, non-commercial use, subject to Apple's Standard End User License Agreement and these Terms.

3. The Service

Awakefit combines an alarm clock with a camera-checked wake-up workout (squats, push-ups, burpees, or deadbugs) and an optional Screen Time-based overnight app-blocking feature intended to help you get out of bed and stay off your phone until you've moved. By enabling app blocking, you (not us) choose which apps or categories to restrict and during which time windows. Awakefit is a self-directed wake-up and habit tool. It is not a fitness coaching product, a medical device, a parental control product, or a guarantee of any specific fitness or health outcome.

4. Your Responsibilities

• You are responsible for managing your device's Screen Time / Family Controls settings and for any consequences of enabling or disabling app blocking.
• You agree not to use the app-blocking feature to restrict or interfere with another person's device without their knowledge and consent. Awakefit is designed for self-imposed restrictions on your own device only.
• You are solely responsible for assessing your own physical ability to safely perform the exercises suggested by the App, and for stopping if you feel pain, dizziness, or discomfort. Consult a physician before starting any new exercise routine if you have a pre-existing health condition.
• You agree to provide accurate information during onboarding (e.g., age range) and not to misrepresent your eligibility to use the App.
• You are responsible for maintaining the security of your Apple ID and the device on which the App is installed.

5. Subscriptions & Payment

Awakefit offers auto-renewing subscription plans (currently weekly, monthly, and yearly, with an optional discounted trial offer), processed entirely through Apple's In-App Purchase system via StoreKit 2.

• Pricing for each plan is displayed in the App and confirmed by Apple at the point of purchase; prices may vary by region and are subject to change with notice.
• Free trials, where offered, convert automatically to a paid subscription unless cancelled before the trial ends.
• Auto-renewal: subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
• Cancellation: you can cancel anytime via your device's Settings → [Your Name] → Subscriptions. We do not have the ability to cancel or refund your subscription directly. Apple manages this.
• Refunds are governed entirely by Apple's refund policies. Please contact Apple Support for refund requests.
• We do not receive or store your payment card details.

6. Account & Data

• You may create an account using Sign in with Apple. Your alarms, wake-up mission settings, and streak data are synced to our servers so you can restore them on a new device.
• You may delete your account and all associated cloud data at any time via Settings → Delete Account in the App. See our Privacy Policy for full details on what data we collect and how to exercise your rights.

7. Intellectual Property

All content within Awakefit, including but not limited to the exercise library, illustrations, mascot, branding, and software, is owned by the Operator or licensed to us, and is protected by copyright and other intellectual property laws. You may not copy, redistribute, reverse-engineer, or create derivative works from the App except as permitted by applicable law.

8. Disclaimers

Awakefit is provided "as is" and "as available." We do not guarantee:

• That you will achieve any particular fitness, health, or wake-up consistency outcome
• That the App will be uninterrupted, error-free, or available at all times
• That camera-based rep detection or Screen Time / Family Controls enforcement will function flawlessly on every device, in every lighting condition, or on every iOS version (this depends in part on Apple's frameworks, which are outside our control)

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by applicable law, the Operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, personal injury arising from performing exercises suggested by the App, or damages resulting from your use of, or inability to use, the App, including any reliance on the alarm or app-blocking features. Nothing in these Terms limits liability that cannot be excluded under applicable law (e.g., liability for intentional misconduct or gross negligence, or statutory consumer rights under German or EU law).

10. Changes to the App and These Terms

We may update, modify, or discontinue features of the App, and may revise these Terms from time to time. If we make material changes, we will provide notice via the App or by updating the "Last updated" date on this page. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.

11. Termination

We may suspend or terminate your access to the App if you violate these Terms. You may stop using the App and delete your account at any time.

12. Governing Law & Venue

These Terms are governed by the laws of Germany, without regard to conflict-of-law principles. Where mandatory consumer protection laws of your country of residence provide greater protection, those laws will apply to the extent required. Any disputes not resolved informally shall be subject to the exclusive jurisdiction of the courts of Germany, unless mandatory local consumer law provides otherwise.
